By using the BrewBattle service, you agree to be bound by these Terms and Conditions. If you do not accept these terms, please do not use our service.
1 Age Requirements
Access to the platform is reserved exclusively for users who have reached the legal drinking age in their country of residence (18+ in Italy).
By accepting these terms, you declare and warrant that you are of legal age.
2 Acceptance of Terms
Access and use of the BrewBattle platform is subject to full and unreserved acceptance of these Terms of Service (hereinafter "Terms"). The user acknowledges that use of the service constitutes acceptance of these Terms.
3 Service and Competition Results
BrewBattle is an online platform for managing and participating in homebrewing competitions and tasting events. The service allows users to register, organize competitions, book events and consult rankings.
Public Nature of Rankings
The user acknowledges and accepts that, by participating in a competition, the results obtained (scores, ranking positions, beer name) constitute an integral part of the public historical record of the event. Such data may remain visible in historical rankings even if the personal account is deleted, possibly in anonymized or pseudonymized form, to ensure the documentary integrity of the competition.
4 User Account
To use some features of the service, you need to create an account.
You are responsible for the security of your account and all activities carried out through it. We encourage you to choose a secure password and not share it with third parties.
Account Suspension and Termination
BrewBattle reserves the unquestionable right to suspend, deactivate, or permanently terminate any account, at any time and without notice, in the event of a violation of these Terms, fraudulent behavior, abuse of the service, or any other conduct deemed harmful to the platform or its users.
5 Usage Rules and Content
Users commit to:
- Provide accurate, up-to-date and truthful information.
- Not violate third party intellectual property or copyright.
- Respect other platform users, maintaining correct and sportsmanlike behavior.
Content License
The user retains intellectual property of uploaded content (e.g., recipes, photos, logos). However, by uploading them to the platform, they grant BrewBattle a non-exclusive, free, transferable and worldwide license for the use, reproduction, display and storage of such content, limited to what is necessary for the operation, promotion and improvement of the service.
Content Removal
BrewBattle reserves the right, but not the obligation, to monitor and remove at its sole discretion any content posted by users (including accounts, competitions, or recipes) that violates these Terms or is considered offensive, illegal, inappropriate, or harmful to the rights of others.
6 Privacy
Your privacy is important. The management of personal data is governed by our dedicated Policy.
7 Payments and Financial Responsibility
Platform Role
BrewBattle acts exclusively as a technology service provider. The platform is not a contracting party in financial transactions relating to competition registrations or event bookings.
All payments made (e.g., via PayPal, Stripe or Bank Transfer) are directed exclusively to the Organizers who manage the individual events. Payments processed via credit card are handled by Stripe. For Organizers utilizing Stripe Connect, onboarding and payouts are subject to the Stripe Connected Account Agreement. Therefore:
- The registration or booking contract is concluded exclusively between the User and the Organizer.
- BrewBattle does not manage, retain or is responsible for payments, nor for any refunds or financial disputes.
- Any refund request or administrative complaint must be addressed directly to the Organizer responsible for the competition.
8 Competition Organization
Users who use BrewBattle to organize competitions ("Organizers") assume full and exclusive responsibility for event management.
- Legal Compliance (DPR 430/2001): The Organizer is responsible for ensuring that the competition, prizes offered and conduct comply with current regulations on prize competitions in their country.
- Indemnity: BrewBattle does not perform preventive checks on the legality of individual competition rules. The Organizer indemnifies and holds BrewBattle harmless from any penalty, claim or damage arising from non-compliance with the organized event regulations.
9 Limitation of Liability (General)
BrewBattle is provided "as is" and "as available", without warranties of any kind, express or implied. Subject to mandatory legal limits, BrewBattle shall not be liable for direct, indirect, incidental or consequential damages arising from use of the service, including data loss, score calculation errors or service interruptions.
10 Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with Italian Law.
Any dispute arising from or related to the use of the BrewBattle platform shall be subject to the exclusive jurisdiction of the local Courts or, if applicable, the Consumer Court according to current regulations if the user acts as a consumer.
11 Modifications to Terms
We reserve the right to modify these terms at any time. Substantial changes will be communicated via the site or email. Continued use of the service after such changes constitutes acceptance thereof.
